1. Introduction
Welcome to Onsite Match (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our mobile and web applications, collectively referred to as the “Service.”
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility & Child Safety
You must be at least 18 years of age to create an account or use Onsite Match. By using the Service, you represent and warrant that you are 18 or older. Onsite Match strictly prohibits minors. We maintain a zero-tolerance policy against Child Sexual Abuse Material (CSAM) and Child Sexual Exploitation and Abuse (CSAE). Any violation will result in immediate termination of your account, permanent platform bans, and reporting to law enforcement and NCMEC. For full details, see our Child Safety Standards
3. Account Registration
You must create an account to use certain features. You agree to provide accurate and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.
4. Use of the Service
You agree to use the Service only for lawful purposes and in compliance with these Terms. You shall not:
a) Impersonate any person or entity.
b) Post or transmit unlawful, harmful, or obscene content.
c) Engage in harassment, discrimination, or misuse of personal data.
d) Attempt to interfere with or disrupt the Service.
5. End User License Agreement (EULA) & License Grant
Subject to your strict compliance with these Terms, Onsite Match Ltd grants you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use the Onsite Match mobile application on any Apple iOS or Android device that you own or control, strictly for your personal, non-commercial use.
You may not:
a) Rent, lease, lend, sell, redistribute, or sublicense the application.
b) Copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, or create derivative works of the application or any updates.
c) Bypass or breach any security device or protection used by the application.
This license will terminate automatically and immediately if you breach any provision of these Terms or the EULA.
6. User-Generated Content & Zero-Tolerance Policy (Apple & Google Play EULA)
Onsite Match allows users to create profiles, upload photos, check into venues, and exchange messages. By using the Service, you acknowledge and agree to our “Zero Tolerance Policy” regarding objectionable, abusive, or harmful behavior:
- Zero Tolerance for Objectionable Content: There is strictly zero tolerance for objectionable, offensive, unlawful, defamatory, harassing, sexually explicit, hateful, or abusive content and behavior.
- Immediate Removal and Termination: Any user who publishes, uploads, or sends objectionable content, or who engages in abusive, threatening, or harassing behavior, will have their content removed immediately and their account permanently suspended and banned without notice or refund.
- Reporting & Blocking:
- a) You have the ability to report any user or content directly within the application using the “Report” feature in chats and profiles.
- b) You have the ability to block any user immediately using the “Block” feature, which instantly stops all communication and conceals their profile.
- c) Our moderation team reviews all flagged reports within “24 hours”. Any confirmed offending content will be taken down, and the offending user will be ejected from the platform.
7. App Store & Platform Disclaimers
If you download the Service from the Apple App Store or Google Play Store:
a) You acknowledge that these Terms are concluded solely between you and Onsite Match Ltd, and not with Apple Inc. or Google LLC.
b) Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the application.
c) Apple, Google, and their subsidiaries are third-party beneficiaries of these Terms and EULA, and upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
8. Subscriptions and Payments
Certain features may require payment. Payments are processed securely through third-party platforms such as Google Play or the Apple App Store.
You agree to comply with the payment terms and policies of these platforms.
9. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any conduct that we deem harmful to the integrity or reputation of Onsite Match.
10. Intellectual Property
All content, trademarks, and proprietary materials available through the Service are owned by Onsite Match Ltd or its licensors. You may not reproduce, distribute, or create derivative works without written permission.
11. Disclaimer and Limitation of Liability
The Service is provided “as is” and “as available.” Onsite Match Ltd makes no warranties of any kind, express or implied, and shall not be liable for any damages resulting from the use or inability to use the Service.
12. Governing Law
These Terms are governed by the laws of Kenya. Any disputes shall be resolved exclusively in the courts of Mombasa, Kenya.
